1. Can we put the home on the market before probate is complete?

Yes.
You don't necessarily have to wait until probate is finalized before getting the home ready to sell.The Ontario Superior Court of Justice can take several months to issue the Certificate of Appointment of Estate Trustee (commonly called probate).

As experienced Ontario REALTORS® who regularly handle estate sales, we include a specific legal clause in the listing agreement that protects the estate while probate is still in progress.

This allows the property to be marketed immediately while the legal process continues behind the scenes.

The buyer understands the process before submitting an offer.

The transaction simply closes once probate has been completed.

The result: You don't lose valuable months waiting for paperwork before exposing the home to the market.

2. What exactly is probate?

Probate is simply the court's official approval of the estate.
It confirms that the Will is valid.It confirms the executor has the legal authority to handle the deceased's assets, including selling the home.Without probate, banks and Ontario's land registry system will generally not release funds 
or transfer ownership of the property.
Think of probate as the legal approval that allows everything else to move forward.

3. What happens if there isn't a Will?

This situation is more common than many families realize.
If there is no Will, there is no legally appointed executor.
Instead, a family member or trust company must apply through the courts to become the Estate Trustee Without a Will (also known as the administrator).
Only after that appointment has been approved can the property legally be listed and sold.
We work closely with your estate lawyer throughout this process to help avoid 
unnecessary delays and keep everything moving forward.

4. Do you have experience selling Parkbridge or leased-land homes?

Absolutely.
This is especially important for families selling homes in Wasaga Beach adult lifestyle communities.
Parkbridge and other leased-land communities have their own approval process and lease transfer requirements.
They also have a Right of First Refusal, meaning certain procedures and timelines
 must be followed before the sale can be completed.
Our team is very familiar with these transactions.
We already have the required forms, understand the process, and coordinate directly 
with Parkbridge so your family doesn't have to.

5. Can you prepare a Date of Death Fair Market Value?

Yes.
We provide these valuations on a regular basis for estate clients.
The Canada Revenue Agency (CRA) requires an accurate market value as of the date of death for probate and Estate Administration Tax purposes.
We prepare that valuation for your estate lawyer.
We also prepare a current market value to determine the best listing price when it's time to sell.

6. Can the property be sold "as is"?

Yes.
Most executors simply cannot guarantee the condition of a property the way an owner who lived there could.
We help protect the estate by preparing the sale as "as is, where is."
Buyers acknowledge the home's condition as part of the purchase process.
This helps reduce liability for the estate while still allowing us to professionally market the property.
We continue to stage the home where appropriate, invest in professional photography, 
and develop a pricing strategy designed to achieve the strongest possible result.

7. I don't live nearby. Do I have to travel back?

No.
Many of our estate clients live outside the area, and quite a few live in another province.
Documents can be signed electronically.
Our team looks after the property locally by coordinating:
